Legal Stuff when taking a picture
« on: May 11, 2006, 05:03:36 PM »
Do we have a previous thread on legalities when taking a picture in public?

Like lets say I'm in a beach and wanna take pictures of girls in their 2 piece, but its mostly head shots. Do they have a right to ask me to erase their picture?

Or do you usually ask first if you can take their picture? But doesnt that take away the natural posture?\

Thanks!!!!

If you gonna post it in public you should ask their permission this is under libel case if so but if it is for your personal use only what ever your shot is it will.

Ang pagkakaintindi ko, as long as it's a public place, you can take pics with no problem.  Hindi mo lang magagamit commercially, pero "editorial," oks lang.

ok let's rephrase it if you want to take picture kahit sino pa sya wether it is in public or private place and you're planning to display it in public like in internet etc. you need to ask permission kasi pag nakita ng mga kinunan yun without their approval at lumabas na kahiya hiya sila pwede sila mag file ng libel case against who took the picture.Pero kung personal use lang naman no public exhibition eh kahit nakahubad pa sila ok lang. :D

hahahahahaha....i dont remember any law na saying bawal...libel kasi when you say something untrue which tends to degrade...I guess copyright law...pero di naman copyrightable beauty nila...and it would definetely fall under fair use kung gamitin mo for personal use...di naman nila profession yun...so i guess di nila pwede sabihin na bayaran sila...encroachment to privacy?...pwede siguro under the civil code, damages, etc... pero walang criminal liability...pero malamang baka naman etiquette rules lang...kakahiya naman kung di magpaalam...baka masapak pa ng BF...heheheheh...

visit this forum, applicable ito sa pilipinas, i think

Where else can you find people smiling, when you sneak in to shoot at them. Only in the Philippines. Our people are so friendly and hospitable. But remember, when you used them for commercial purposes, you need a model release form or else their cousin "lawyer" might advise them to sue the client that brought your photo. I dont see any problem if you shoot them for your own use.

thanks for this post, i am so tempted already to post some pics i took from a program. but come to think about it. I do not know them and they do not know me. worst is they're very private persons.

so i guess that stays in my portfolio, not in the net

mga sirs.. tanong lang where can i have or see a sample of model release form? meaning when after taking a picture of a person that you intend to publish publicly, i have to let them sign the form stating their consent? ???
No Past. No Future. Just the moment.

Photography is a window where you can appreciate simple things in Life you didn't even seem to take notice of...

Not everybody understands house music. It's a spiritual thing, a body thing, a soul thing.

Its just a piece of paper stating that this person of legal age allows this photographer to use his or her images for whatever purposes he choose indefinely in return for X amount or service. If under age, must have signed by a guardian. When you have this form, now you can sell this image commercially.
