Hello fellow PiPhos,

I'm not sure if this topic has been discussed before as this incident happened to me several times already.

During photoshoot/funshoot, fortunately, I have the superior/more expensive gears than most of my co-shooters, so, if I take a rest or break, most of them will try my cam on our subject, and afterwards will tell me they would ask for copies of the shots they took for obvious reasons.

In these cases, do they "really" have the right of those photos and use them on their respective portfolios?

thanks for your reply sir, ako pala talaga ang nakalagay sa disadvantage lahat, gears ko na nga ang ginamit, ako pa ang kokopya sa cd/usb nila and they all get the pogi points on their respective portfolios  >:(

di pa nga ako nakakita na may taong binigyan ng credit for using their gears. only models/subjects, hmuas, location, director get them...

hehe. you can always say you own the pics, kasi nga iba ownership, iba copyright. but that's being technical/legal about it. and at the expense of causing some friction between you and your friends...

or next time you can say, " oi, bigyan nyo ako credit sa pic na kinuha nyo gamit gears ko, kung wala gears ko, hindi ganyan ka ganda pics nyo!"  ;D ;D

What disadvantage? Diba willing mo naman pinahiram yung gamit mo? If you're gonna feel sour about people making great photos with your gear then wag mo pahiram ::)

Basicaly whoever is behind the camera during the time the shot was taken, owns the copyright of the image, no matter if the camera was borrowed or owned. If not then all the camera rental companies would own the copyrights of all their client's photo.

Though there is an IF to this, if the person behind the camera was employed by photo studio as a photographer, all the photos shot by the photographer for the studio is owned by the studio.

another analogy would be if you were a group of painters, you lend someone your palette, brush and canvas to another person. The artwork created by that person belongs to him. You cannot claim ownership over it.

@Edison very nice analogy! :)

+1 din kay someone  na don't lend them your gears, sayang nga naman ang actuations  ;)  Also, when they borrowed your cam did they specifically borrowed for your cam so that they can use what they took for their portfolio? If not, then lesson learned! :) Wag  na lang pahiramin next time. :) :) :)

yun lang talaga ang mahirap kung friends mo na ang mga kasama mo sa shoots, di mo matanggihan  :D

friends mo naman pala sila eh. Either pagsabihan mo, huwag mo nang pahiramin or find a new group of friends.

I think what the ts meant by "disadvantage" was that may wear and tear na nga yung gear nya dahil sa use nila, sya pa ang mag e-effort to transfer and copy files for them.

I agree 100% with sir kengo as to the copyright  :)
