Warning: Protect Your Rights As Photographers

This is a warning to those who shoot for ABS-CBN publishing magazines, or those who might be approached to shoot for them.

I’m  helping my friends who are professional  photographers who shoot for magazines. Ito po ang mensahe nila “DON’T SIGN” .
I am helping  them out by spreading the message not to sign the contract that ABS CBN is trying to force the photographers to sign.

Ito po daw ang mga problema sa contract

1.   ABS CBN will fully own all the rights to the photos. Eh di naman dapat.  According to the law, ang may ari ng copyright ay ang photographers. Even if commissioned ang photographer by a publisher, the publisher only has rights to use the photos once. One time lang. Kung gagamitin nila ulit, they have to ask permission of the photographer and pay. Now they want to remove that right from the photographers.

2.   Sa contract nila, the photographer has to get written permission pa from ABS CBN if they want to use it in their portfolio or website. Di tama yan.

3.   Kung ABS CBN ang may ari ng photos at wala nang say ang photographer, puwedeng ibenta ng ABS CBN ang photos sa kahit sino mang advertiser for big amounts, yet they only paid the photographer peanuts.  At siyempre, since ABS CBN would fully own all the rights to the photos, the photographer cannot earn from it anymore.

4.   Part pa ng contract is this: if you shoot for ABS CBN publishing, you cannot shoot for any competitors. Eh, iilan lang ang magazines nila at ang baba ng bayad nila. Sino ba naman ang mabubuhay sa ganyan.

Why this warning? Because ABS CBN Publishing is trying to pressure and force photographers to sign. If this happens and people sign, then what will stop others from following. Kung bumigay ang photographers sa patakaran na ganyan, na walang respect and value for their own work, di saan na mapupunta ang  photography industry.

As of now, majority of the photographers are refusing to sign, pero pressure is being put specially on the newer and younger photographers. Ang iba daw are not being hired for shoots until they sign. May nasabihan din daw that they will not be paid until they sign (di ba extortion ang tawag diyan?)

Eto pa, ang masama. Diba ang contract ay agreement between two parties wherein both have responsibilities and both should get something out of it. Una, there was no negotiation or consultation sa photographers. Fully one sided ang contract.
And two, there is nothing offered or given to the photographer. The contract does not offer any benefit or advantage to the photographer.  Tinatanggal ng contract ang lahat ng rights ng photographer, even the right to display the work is conditional, and even the right to earn a living as a photographer is limited – at walang kapalit.

Sabi ng mga pros, if the amount they are paying was worth it, then why not, but sobrang baba naman daw. They pay low editorial rates but they are demanding even much more and much higher than what advertisers (na nagbabayad ng mataas) requires.

 Kung ako po ay tatanungin, this is a sign of total lack of respect sa photographers na partners nila sa magazines.

So, please  don’t sign and tell others not to sign.  Huwag sana po pumayag ang mga photographers sa kalokohang ito.
