I personally know this guy, Hersley Casero is a very well respected artist here in Dumaguete, and also a very well respected photographer in the community here. He has done shows and talks for our club and the public. Browse his deviantart page.

Sa side po ni Hersley, Gusto lang po niya pumunta ng Dumaguete yung artist at mag apologize sa kanya at sa nephew niya, kasi yung nephew niya daw mismo nanood ng Show and was wondering why na sa show "Cancer Survivor" daw siya.

I've seen posts of some very well known photographers dito na ginamit ang photos nila sa ibang website. Maraming inputs at comments. Sana naman po may makatulong din dito, kasi hindi lang yung kumuha ng photo yung affected, pati yung bata mismo sabi sa akin medyo na shocked/confused daw kasi akala nya may sakit siya.

Hersley is a good friend of mine too... Actually a mentor when it comes to photography... We tried calling Kapuso, asking for some action about this matter but instead they are trying to ignore us even up to the point of dropping the call...

Hope you can also help us on our campaign against this one...

Try posting some comments on their Facebook Page... http://www.facebook.com/kapusomojessicasoho

Thanks.

Can someone enlighten me? How can you steal somebody's work when the medium used is not the same? If anything else, inspiration was drawn on the photograph of the child. Not even sure if the artist himself was aware of the facts regarding the photograph's subject. Puwedeng factual errors/representation of the subject. But I wouldn't go as far as stealing someone's work.

There are technicalities regarding the real accusation.Did the artist really misrepresented it and even went to lie about the real facts? Were the 2 photographs, the same? One is in black and white the other one is manipulated. Both images have a lot of obvious similarities.
The one is in Dumaguete and the other one is in Batangas.Maybe you could be right that the artist does not know the real background of the picture. Someone just downloaded and manipulated it and told him a different story.
It could be a "stolen" laughter...maybe.

You probably have a a case here although i'm not sure how much since the way I understand it, the work of the artist in question is the Spaghetti plating he made based on the picture of the child.

Here's an idea. Share your complaint with ABS-CBN / Channel 2. They'll most likely grab this opportunity to stick it to GMA-7 ;D

First of all salamat po sa mga sumagot.

I believe you cannot steal when it's an inspired idea. But i think if you're going to copy something and using another medium, shouldn't you be crediting where you got it?

The black and white was the one posted sa internet. Nowadays sandali nalang po magkulay ng black and white photos diba? look at the similarities sa black and white and hindi black and white. especially yung kahoy sa likod (or bamboo ba yan).

If you read the article sa first link, nanood yung bata(nephew niya) kasi alam nya it was inspired from Hersley's photo. Isipin mo ba naman, bata lang yun tapos sasabihin sa tv na cancer patient survivor siya?

And before all of this. Mismo si Sir Hersley was excited na naka inspire photo niya to make food art, and was posting of how excited he was to see the show and all, and para maka thank you siya because he knew na it was inspired from his photo.
